Azimuth Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Tiger Bomb LLC ("we," "us," "our") governing your use of the Azimuth mobile application ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions (the "Usage Rules"). You may not copy, modify, reverse-engineer, redistribute, or create derivative works from the app except as permitted by law.
2. Not financial advice
Azimuth is an informational tool for tracking your own assets and net worth. It does not provide financial, investment, tax, accounting, or legal advice, and nothing in the app is a recommendation to buy, sell, or hold any security or asset. Market prices and other data may be delayed, incomplete, or inaccurate, and are provided on an "as is" basis. You are solely responsible for your financial decisions and should consult a qualified professional before acting. We are not a broker-dealer, investment adviser, or financial institution.
3. Your data and content
You are responsible for the information you enter into the app and for maintaining your own backups. Your data is stored on your device and, if you enable backup, in your own iCloud account. Our handling of information is described in our Privacy Policy.
4. Subscriptions
Azimuth offers an optional auto-renewing subscription ("Azimuth Pro") that unlocks additional features.
Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription in your App Store account settings after purchase.
Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
Prices and available features may change; changes will not affect the period you have already paid for.
All purchases are processed by Apple and are subject to Apple's terms. Refunds, where applicable, are handled by Apple in accordance with its policies.
5. Acceptable use
You agree not to use the app for any unlawful purpose, to interfere with or disrupt the app or our servers, to attempt to gain unauthorized access to any system, or to use automated means to access the app or the data it provides in a manner inconsistent with these Terms or the terms of our data providers.
6. Third-party data and services
The app displays market data obtained from third-party providers and relies on Apple services (App Store, iCloud). We do not guarantee the accuracy, timeliness, or availability of third-party data or services, and your use of them may be subject to their own terms.
7. Disclaimers
THE APP AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIGER BOMB LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR FINANCIAL LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your access to the app at any time if you violate these Terms. You may stop using the app at any time by deleting it. Sections that by their nature should survive termination (including Sections 2, 7, 8, and 10) will survive.
10. Apple-required terms
You acknowledge that these Terms are between you and Tiger Bomb LLC only, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules, except where local consumer-protection laws require otherwise.
